How Litigation Works
In litigation, parties retain family lawyers to represent them at court. The lawyers employ the adversarial process, where each side in a dispute has the right to present its case as persuasively as possible, subject to the rules of evidence, and a judge decides the outcome.
Sometimes adversarial litigation is necessary when the parties can’t agree on an outcome or if the conflict is so profound that other processes aren’t available. Litigation tends to be m
ore expensive – both financially and emotionally. Family Court has very strict rules and procedures, which can sometimes be quite confusing to clients. However, for some people, litigation is the only way to resolve a case.
